These terms govern your use of the Lusso Staff International & Academy website and services.

1. About us and these terms

This website and the services described on it are operated by LUSSO STAFF LIMITED, a company registered in England and Wales under company number 16756433, with its registered office at 21–24 Millbank, Millbank Tower, 7th Floor, Office 7.11, London, England, SW1P 4QP ("Lusso Staff", "we", "us" or "our").

These Terms of Service ("Terms") form a legally binding agreement between you and us and govern your access to and use of our website at https://lussostaff.com (the "Site") and the services we provide through it. By accessing the Site, registering an account, or submitting an application or enquiry, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Site or our services.

2. Definitions

  • "Candidate" — an individual who registers with us seeking temporary or permanent work placements.
  • "Client" — a hotel, venue, business or private individual who engages us to supply staffing, cleaning or related services.
  • "Services" — our hospitality staffing, professional cleaning, and academy training services, together with the Site.
  • "Assignment" — a placement of a Candidate with a Client, whether temporary or permanent.

3. Our services

Lusso Staff provides recruitment and supply of hospitality and cleaning staff, managed cleaning services, and professional training through our academy. We act as an employment agency and/or employment business as those terms are defined in the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003, and we comply with those rules where they apply.

We may change, suspend or withdraw all or any part of the Site or Services at any time. We do not guarantee that the Site or its content will always be available or be uninterrupted.

4. Eligibility and accounts

You must be at least 18 years old to register as a Candidate or Client. When you register, you agree to provide accurate, current and complete information and to keep it up to date. You are responsible for keeping your account credentials confidential and for all activity that takes place under your account.

Candidates must have, and be able to evidence, the legal right to work in the United Kingdom. We are required by law to verify right-to-work and, depending on the role, may require additional checks such as DBS (criminal record) checks, SIA licences, references and qualifications. Providing false, misleading or incomplete information may result in your application being rejected or any Assignment being terminated.

5. Candidate terms

  • You confirm that all information, documents and references you provide are true, complete and your own.
  • You consent to your personal data, CV and references being shared with prospective Clients for the purpose of securing work, as described in our Privacy Policy.
  • You agree to attend confirmed Assignments punctually, to behave professionally, and to comply with the reasonable instructions, policies and health-and-safety requirements of the Client and of us.
  • You agree to record working time accurately (including via any check-in / timesheet tools we provide) and acknowledge that pay is calculated from approved timesheets.
  • Registration does not guarantee any minimum amount of work, and we do not guarantee that any Assignment will be offered or will continue for any period.

6. Client terms

  • Bookings and Assignments are subject to availability and to any separate written agreement or rate card between us.
  • You agree to provide a safe working environment and to comply with your obligations under health-and-safety and employment legislation in respect of staff we supply.
  • Charges, invoicing arrangements and payment terms are as set out in your booking confirmation, rate card or services agreement. Unless otherwise agreed, invoices are payable within the period stated on the invoice, and we may charge interest on late payment in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
  • You must not solicit or engage a Candidate introduced by us outside our arrangements without our prior written agreement.

Introduction and transfer fees

If, during or following a temporary Assignment, a Client wishes to engage a Candidate directly (or introduces the Candidate to a third party who engages them), Lusso Staff will be entitled to charge an introduction or transfer fee, or to require an extended period of hire, in accordance with our applicable terms or the Conduct Regulations. 7. Payments and pay

Where we engage Candidates on a temporary basis, pay is calculated from approved timesheets and paid in accordance with the pay arrangements notified to the Candidate (for example, weekly pay), subject to lawful deductions such as tax and National Insurance. Client charges are invoiced as agreed in the relevant booking, rate card or services agreement.

8. Acceptable use

You agree not to:

  • use the Site or Services for any unlawful, fraudulent or harmful purpose;
  • submit information that is false, misleading, or that you do not have the right to provide;
  • upload content that infringes the rights of others or that contains viruses or other harmful code;
  • attempt to gain unauthorised access to, interfere with, or disrupt the Site, its servers, or any connected systems; or
  • copy, scrape, or systematically extract data from the Site without our permission.

9. Intellectual property

The Site and all of its content, design, branding, logos and trade marks are owned by or licensed to Lusso Staff and are protected by intellectual property laws. You may view and use the Site for your own personal or internal business use only. You retain ownership of content you submit (such as your CV), but you grant us a licence to use it for the purposes of providing the Services and as described in our Privacy Policy.

10. Third-party links

The Site may contain links to third-party websites or resources. We provide these for your convenience only and are not responsible for the content, products or services of those third parties.

11. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all representations, warranties and conditions that are not expressly set out in these Terms. Nothing in these Terms affects your statutory rights as a consumer where they apply.

12. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

Subject to the above, we will not be liable for any loss of profits, loss of business, business interruption, or loss of anticipated savings, or for any indirect or consequential loss. Our total liability to you arising out of or in connection with the Site and these Terms will be limited to the greater of the fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or £100.

13. Indemnity

You agree to indemnify us against any losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or Services.

14. Suspension and termination

We may suspend or terminate your access to the Site or Services, and remove your account, at any time if you breach these Terms or if we reasonably consider it necessary to protect us, our users or third parties. You may stop using the Site at any time.

15. Changes to these Terms

We may update these Terms from time to time. The version published on this page is the version that applies. We will update the "Last updated" date when we make changes, and your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

16. Governing law and jurisdiction

These Terms, their subject matter and formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that if you are a consumer resident elsewhere in the UK you may bring proceedings in your home jurisdiction.
